Who gets custody?
Each minor child should have regular contact with both parents even after the divorce and parents should share all rights and responsibilities. According to that guideline, the court usually orders shared parental responsibilities. However if one of the spouses is convicted for domestic violence the court will order a sole parental responsibility, and make such arrangements for visitation that would protect the child and the other spouse from further harm.
When ordering shared responsibility the court can consider the desire of the parents and grant to one person the responsibility over specific aspects of the child’s life, including residence, education and medical care. However the access of both parents to the child’s school, medical and dental record cannot be denied. Also, important decisions that affect the child will be equally made by both parents.

While dealing with legal issues regarding the future of their children parents should also not forget about their emotional life. Children are sometimes more affected by a divorce than their parents. They often consider themselves responsible for the events, and may feel sadness, anger and loneliness. It is important to manage a divorce so that it would have the minimum possible affect on the child. Conflict should be avoided in the child’s presence and both parents should encourage the child’s relationship with the other party.
Therefore Florida law requires parents to complete an approved 4-hour Parent Education and Family Stabilization course, with the purpose of minimizing the emotional impact on children. The Court will only grant the dissolution of marriage after both parents completed the course.
