It is in your best interest to remain silent. Law enforcement is trained in interviewing to win your trust and confidence. Once you feel comfortable, they move into the interrogation. Be polite but ask to call an attorney. One has to learn to protect your Constitutional rights.
1
DUI Arrest
Don't refuse to take the breath test or whatever test that is offered. The breath test is the best for the defense. A refusal could result in extra penalties from both the Court and the DMV.
2
Driving On A Suspended License Due to A DUI
After one is arrested for a DUI their license will be suspended. The length of that suspension depends on whether this is the first DUI conviction. When one drives during the suspension period and is arrested, the fines could be over a thousand dollars with a mandatory 10 days of custody. One needs to contact an attorney immediately to review the case, see if there is a defense, decide whether a motion is available or negotiate a plea bargain that might avoid the high fines and time in jail.
3
How A Petty Theft Can Turn Into A Robbery
When one steals from a store, no matter the value of the property, this theft can turn into a robbery called an "Estes Robbery". This happens when the person committing the theft attempts to leave the store or the store parking lot without paying for the items taken. Then, the store security guard or store personnel request the property to be turned over to them. The person taking the property refuses to comply. The security guard tries to retrieve the property and a struggle takes place. It doesn't matter who started the struggle or who was more aggressive. An Estes Robbery is a strike under the 3 strike law. For more information about this or other crimes visit our website.

What To Do When Stopped For Drug Possession
Again it is important to protect your rights by remaining silent. Be polite, but remember you have a constitutional right not to speak to law enforcement without an attorney present or speaking to one first. For example: Lets say you are in a vehicle with someone who has drugs in the vehicle. The sheriff makes a traffic stop and questions you about the drugs found in between the seats in the car. You acknowledge you knew the drugs were in the vehicle. You could be charged with "Constructive Possession" even though the drugs were not yours and you had no intent to use them.
