Restaurant Expert Witness, Restaurant Consultant, and CEO, Howard Cannon continues to state that “requiring wait-staff to participate in a ‘tip pool’ is poor management and should be illegal.”

Tip pooling continues to be a controversial subject in the food service industry, as well as the topic of numerous lawsuits by restaurant employees and a focus of legislation being considered by several states. Cannon states, "I think you will see more lawsuits come to light over the next decade or so as employees figure out that their rights are being violated by employers trying to create more ways to reduce their cost of labor – even if it is to the detriment of their own employees and their own business.”

“Tip pooling waters down all facets of good restaurant service,” says Cannon. “The best servers will quit working for restaurants that require tip-pooling in favor of those who don’t, so they can profit personally from their superior skills – as it should be. Restaurants that require tip-pooling will be plagued with mediocre operations and poor service because the servers who remain have no incentive to work harder to earn a better gratuity from the customer. And, when the lawsuits commence, the companies that require tip-pooling will lose in more ways than one.”

Cannon has worked in the trenches of restaurants for more than 24 years (since 1987), and has been serving restaurant and bar clients of all types and sizes in markets across America and around the world. He is the CEO of Restaurant Expert Witness and Restaurant Consultants of America, and the author of The Complete Idiot’s Guide to Starting Your Own Restaurant©, Volume I & II, published by Alpha Books and found in bookstores in more than 76 countries around the globe.
