How many times have you entrusted your physician’s judgment when they recommended a pharmaceutical that would better your quality of life? Nearly half a million people are injured each year due to defective drugs leaking into the market place. Thousands perish from their injuries, which occur most commonly due to:

• Unforeseen side effects arising after long-term usage.
• A drug is improperly prescribed.
• Pharmaceutical companies turn a blind eye to test results.
• Either the Food and Drug Administration or the pharmaceutical companies failed to thoroughly test a drug

Categories of Defective Drugs

Pharmaceutical injuries can be sustained from any type of drug. No category of drug is immune to having the ability to incur damage to those who take it:

• Diet drugs have a tendency to reveal negative side effects after long-term usage, such as Fen-Phen in the early 1990s.
• Pain killers, such as OxyContin, are likely to cause addiction and may lead to substance abuse.
• Anti-anxiety medications, or drugs used to treat depression, are occasionally found to have the opposite effect, such as Paxil, which increased suicide rates among children.
• Even the immensely popular erectile dysfunction drug Viagra has been proven to cause a decline in blood pressure and can lead to a loss of vision.

Who is Held Accountable in Pharmaceutical Injury Lawsuits

In the vast majority of pharmaceutical injury cases, one of the following parties is found negligent in their professional responsibilities and held responsible for damages:

• Physician – If the wrong drug was prescribed to a patient, which may be the grounds for a medical malpractice lawsuit.
• Pharmacist – If they filled the wrong medication or indicated an improper dosage amount, which may be grounds for a medical malpractice lawsuit.
• Drug manufacturer – If the company fails to adequately test the drug prior to releasing it, or attempts to hide its side effects, which may be grounds for a defective products lawsuit.
