Tania Foster, wife of a farmer, incurred a permanent leg injury when she fell down in a hole at a “Safety Awareness Day” for agricultural workers sponsored by the Health and Safety Executive (HSE). Fortunately, she was able to receive £25,000 compensation from HSE.

Mrs. Foster attended the health and safety workshop on how to avoid farm accidents. She was amongst a group of people who were having a conversation with an HSE inspector while on their way to a demonstration on the safe use of ladders, when she suddenly fell into an open drain.

Mrs. Foster suffered Achilles tendon and metatarsal injuries and now needs to wear ankle bracelet permanently and continuously take painkillers.

After the accident, Mrs. Foster was angry about the attitude of the HSE lawyers who blamed her for this misfortune and decided to bring the case to court.

The HSE however stressed that it carried out a risk assessment of the farm where the event was held and that a Health and Safety Awareness Officer visited the location three times. Furthermore, they claimed that they did not see the need to cover the drainage hole since it is a common attribute of farms and the event was intended for farm workers anyway.

In the end, despite all the arguments, the HSE agreed to an out of court settlement shortly before the case was due to come to court. Although they did not accept responsibility for the incident, they agreed to pay Mrs. Foster £25,000 for compensation and legal costs respectively.
