After a 45-year career as an electrician, Mr. Morton developed asbestosis whilst working on various jobs from 1954 to 1983. The condition he suffered caused him to endure colds which last for week for weeks and left him with shortness of breath.
The insurer of his company admitted liability but refused to give pay out when he brought a claim for compensation. They relied on a decision recently made by the House of Lords regarding pleural plaques. Pleural plaques are a form of lungs scarring due to the penetration of asbestos fibres. The House of Lords ruled out that no compensation is payable to people who developed it as a result of exposure to asbestos at work since pleural plaques do not itself cause any physical symptoms.
The question raised by Mr. Morton’s case was whether asbestosis is similar enough to pleural plaques to be covered by the same ruling. It was then argued that asbestosis is sufficiently different and the insurers agreed to a £ 5,000 provisional settlement just four days before the case was due to go to court.
The good thing about the settlement is Mr. Morton can claim additional compensation in the future should his condition worsen.
Asbestosis usually affects people who have been exposed to asbestos for a long periods of time and the main symptom of this is shortness of breath which may be accompanied by cough and chest pain. Sufferers of this condition have higher chances of developing lung cancer as well as other respiratory conditions.
