Legal advice in tardive dyskinesia cases

Tardive dyskinesia is a serious, neurological disease. Affected persons show signs of uncontrollable body movements, including rapid eye blinking, lip smacking and involuntary finger movements. The gravity of the symptoms vary from one patient to another, but in some cases it can be so severe that affects arms and legs too, making walking difficult.

TD causes and treatment
Tardive dyskinesia can be caused by several factors including traumatic head injuries, alcohol and drug abuse, but the most common cause is the long term use of anti-psychotic drugs, prescribed to treat psychiatric disorders. First generation drugs have a greater chance of developing the disorder than newer generation anti-psychotics.

However there is no need for a person to suffer from psychiatric illnesses in order to be at risk of developing tardive dyskinesia. Some more common medications, like Reglan, used to treat gastrointestinal problems can develop the movement disorder as a side effect.

Although the medical community studies TD for over 30 years there is still no generally accepted treatment. Doctors usually advice their patients to minimize the dosage or to stop taking the drug that developed the disorder. However this procedure does not guaranty that the symptoms will stop in case of every patient. Some of them will continue facing tardive dyskinesia for a long time after the use of the drug has ended.

Legal advice
Prescription drugs were created in order to help people, not to cause them additional problems. When a person is taking medication for gastrointestinal issues he should not have to suffer movement disorders especially if he was not warned about that potential risk.
Tardive dyskinesia symptoms are often embarrassing and prevent affected patients from leaving the house. If you or a family member suffered such injuries as a consequence of a medication you should contact a personal injury lawyer in order to discuss your legal options. If you have a valid claim you are entitled to financial compensations.
