I have been writing to reveal the falsehoods of the tort reform movement for the past eight years. The movement has been around since the post-WWII rise of the conservative tort reform movement.
The conservatives began campaigning against what they saw as unrealistic damages and verdicts against corporate defendants, doctors, and insurance companies who insure them. They call their objective "tort reform". They see this as a way to save American business from unnecessary law suits they call "frivolous". How do they feel about the legal system when their loved ones are injured by negligence?
The point they and their misled supporters miss is that the founding fathers of this country adopted the English system of law on July 4, 1776. That system was (and remains, with many adaptations by the American jurisprudence system) a marvelous invention that provided for resolution of legal disputes over negligence, liability, and damages through a court system that has built-in devices to achieve fair results for all parties to a dispute. The American jurisprudence system is far superior to achieve fairness than the hamhanded "reforms" proposed and actually enacted in many jurisdictions by the "reformers".
