The Federal Motor Carrier Safety Administration (FMCSA) oversees all national truck cab and tractor-trailer regulations. This branch of the U.S. Department of Transportation is responsible for making sure truck drivers and the companies they work for adhere to federal trucking laws, and can impose harsh punishments for those who fail to do so.

The rules and regulations put in place by the FMCSA are intended to protect both the trucker and all other drivers on the road. These laws are enforced through audits and at weigh stations on every major U.S. highway. Despite the efforts of the FMCSA, preventable truck accidents continue to be a major problem on our roadways. When you or a loved one are injured in a truck accident, you need an experienced attorney on your side to make sure the company, the driver, and every other responsible party is held accountable for negligence and/or recklessness.

Federal Trucking Law Basics

Federal trucking laws cover every aspect of operating a commercial vehicle. Of course, there are obvious laws including those that prohibit drug and alcohol use and mandate insurance coverage; these apply to every driver on the road. However, truckers have many additional regulations that must be followed.

Some of these trucker-specific regulations include:

• A truck driver must be at least 21 years old
• A truck driver may not drive more than 16 hours in any 24 hour period
• A truck driver must attend safety courses
• A truck driver must have a current commercial driver’s license
• A truck driver must adhere to both scheduled and necessary maintenance of his vehicle

In addition to these regulations, the FMCSA has regulations for trucking companies that include:

• How heavy a load can be
• Proper loading and securing
• Proper maintenance of trailers
• Demands that can be placed on a driver

The penalty for failure to adhere to any of these regulations can range from heavy fines to company closure.

Truck Accidents Still Occur

Despite these regulations, avoidable truck accidents are still all too common on our roadways. Trucking accidents account for over 90% of all car accident deaths, and an untold number of serious injuries. When a company or a driver violates FMCSA regulations, an experienced truck accident attorney can make sure you are fully compensated for all of your injuries.
