Employee background check is relatively common in all organizations. Now the question may arise, why does an employee want to check background? The purpose of pre-employment background check is quite obvious. It has been established that this practice is necessary to avoid lawsuits and costly hiring mistakes. According to the report disclosed by The Society for Human Resource Management Workplace Violence Survey, over 96% of HR professionals admit that their companies do background checks to new employees to avoid corporate scandals, or workplace violence.

If you are hiring someone, you can and will be held legally and financially responsible for the action of your employee. Keeping this in mind, various federal courts have ordered employers to conduct pre-employment screening on prospective employees, irrespective of their talents and educational qualifications. The background checks for employment can be conducted by the employers themselves or can be undertaken through some accredited agencies that handle such jobs. It is a good idea to conduct a federal criminal check on the employees in order to identify criminal convictions on Federal charges including, but not limited to, securities and tax law violations, immigration violations, embezzlement, terrorism, weapons violations, interest drug crimes and civil right violations.

There are certain guidelines to follow, set by Fair Credit Reporting Act (FCRA) when performing a background check by an external third party agency. As an employer, you must adhere to law when using an agency to conduct a background check for employment. You must provide a written disclosure to the employee clearly stating that the agency will abide by state laws and federal laws as well as FCRA guidelines while performing the check. This will protect the privacy right of an individual or employee. Apart from educational and medical records, employee background checks may include records, such as driving motor vehicle records criminal records, court records, credit reports, sexual offender registers, to name a few.

To sum up, hiring a person requires some homework. It is a good idea to speak with a consultant of a background check agency to further explore your screening options. This may prevent an employee to go against the interests of the company and the position he has been hired for.
