Since December 1st, 2003 it has been considered illegal to drive in the UK using a mobile phone. In fact, any person caught using a mobile phone while driving faces a minimum 60 £ fine and 8 points on your driving licence.

The law stipulates that, depending on the severity of the offence, fines could reach upwards of 1000 £ for private drivers, while a professional driver of vans, trucks, or buses, faces a maximum of 2500 £.

Although the legislation was passed over 4 years ago, the Department of Transport has discovered that up to one third of drivers were either ignorant of the new law or ignored it.

The following activities are also illegal under this law:

• “Texting” while driving is still considered using your mobile – it’s illegal
• You cannot answer incoming phone calls
• Using your mobile in a traffic jam is still considered illegal

If You Can’t Use Your Mobile In the Car, Then What?

There are many alternatives and special cases in which you can use a communication device in your car legally. For instance, the law does not extend to hands-free use of equipment.

Some of the special cases where mobile use is permitted:

• If the phone is held in a cradle, users will not be prosecuted. Drivers should still use caution, as these devices can still be distracting
• Calls to 999 (or 112) are allowed in emergencies
• Passengers are still permitted to use mobile phones

There are already enough distractions on the road today. Mobiles provide security and safety while driving, but they should not be used behind the wheel.

Avoid any distraction that may take your mind off your task at hand: arriving at your destination safely.
