Difference between Birth Injury and Misdiagnosis

The birth of a new child is not always a joyous time. Unfortunately, injuries and complications can arise before, during and after the delivery. In some cases, this can be due to the negligence of the attending medical staff. In other cases, the injury may be the result of a misdiagnosis.

Birth Injury
A birth injury occurs during the birth when a doctor, nurse or other medical professional is negligent and the baby is injured. Injuries can vary from mild cases that will heal over time to severe lifelong disabilities. Some types of birth trauma happen when the baby is making its way down and out of the birth canal. However, other types occur when a healthcare provider fails to evaluate or respond to a complication during labor or delivery. Many birth injuries can lead to medical malpractice lawsuits.

Common birth injuries include:
• Bruising
• Lacerations or abrasions
• Fractures or bone injuries
• Nerve damage
• Brain damage
• Brain hemorrhaging
• Cerebral Palsy
• Erb’s Palsy
• Facial paralysis
• Injuries from forceps or vacuum births

Misdiagnosis
A misdiagnosis is when an illness or condition is improperly diagnosed, overlooked or missed. A patient may be treated for something they do not even have, or are treated for the wrong disease. Often, unnecessary surgeries and treatments are a result of a misdiagnosis, which can affect a person for the rest of their life.
The following are common reasons for a misdiagnosis:

• Negligent, incompetent or inexperienced medical staff
• An unusual condition that the doctor is not familiar with and does not recognize the signs and symptoms
• Failure to read test results properly
• Failure to offer or perform specific tests
• Faulty medical equipment

In addition a delayed diagnosis of a disease or medical disorder can have grave or even fatal consequences. For some, it may be too late. A misdiagnosis can also lead to a medical malpractice lawsuit.
