When a medical device, like a hip implant for example is released on the market and it’s not working properly it will cause more damage than help. If a hip implant is not working properly it will cause the patient discomfort, growing pain, difficulties in movement, possible hip dislocation, bone fracture and the release of toxic metals in the organism. The only solution in this case is a revision surgery performed in order to remove the defective implant and to replace it with a new one. But revision surgeries performed on elderly people can often cause severe complications, including:

• Thrombosis
• Infection
• Implant dislocation
• Injury to the arteries or nerves
• Shortening of the leg
• Femur fracture
• Permanent loss of range of motion

Seek legal compensation
If a person is forced to undergo a revision surgery because of a defective hip implant he is legally entitled to compensations for pain and suffering, physical incapacity, disfigurement and future medical expenses. However there are several facts that he or she should consider.

The fact that an implant device has been recalled by the manufacturing company it doesn’t mean that all the patients who have such an implant will be compensated. In order to have a valid claim for compensation a patient will have to prove that the device caused him injuries.
It is also extremely important that patients do not sign any agreements with the manufacturing company before talking to a personal injury lawyer.

Patients should also ask for a blood test for chromium and cobalt levels before the revision surgery, and the preservation of tissue samples and the ex-planted implant. All those will be used as evidence in case of a hip implant lawsuit.
