Compensation Benefits

Your workers’ compensation wage benefits will be calculated based on your weekly wage. For temporary disability and permanent partial disability, your benefits will expire after a set period of time. For permanent total disability, your payments will continue for the duration of your injury.

A workers’ compensation attorney can assist you in determining the total amount of wage compensation you are due.

Medical Compensation

You are entitled to receive full medical compensation under workers’ compensation, including:

• Doctor appointments
• Surgeries
• Medication
• Necessary medical equipment
In addition, if you are required to travel more than 20 miles round trip for any medical services, you are entitled to receive travel reimbursement. You will continue to receive these benefits as long as your disability requires medical intervention.

Workers’ Compensation Death Benefits

In the unfortunate event of a work-related fatality, spouses and dependent children are entitled to file for workers’ compensation death benefits. With these benefits, surviving family members may receive:

• 2/3 of the deceased’s weekly wage
• Up to $3,500 in funeral expenses
To be eligible for workers’ compensation death benefits, your loved one must have died within six years of the work related injury, or within two years of the date of discovery. This benefit is intended to cover both accidents and long-term work related injuries.

Why Hire an Attorney

No matter what type of workers’ compensation claim you are filing, you will need an attorney on your side. A workers’ compensation attorney will be able to assist you in filling out paperwork, and will make sure that all accompanying medical information is included. This can be a terribly confusing and complex process to complete on your own. An attorney can help streamline the process, and make sure you are provided with the total compensation you are due.

Attorneys’ fees for workers’ compensation are capped by state law. In some instances, your attorney’s fees will be folded into your total benefit amount. Because an attorney can be so helpful during every part of your claim, these often negligible fees are well worth the exchange of a hassle-free and smooth claims process.
