The main idea of filing a lawsuit is to come up with a just resolution for a conflict. This is the main reason why both parties, the plaintiff and the defendant, in a civil litigation are required to present their evidences and defenses for that matter.
Primarily, the plaintiffs carry the burden of proof since they are the parties complaining. They are then expected to prove their case by presenting as much evidences as they can. These may be in form of documents or statements from witnesses. Afterwards, the defendants will be given a chance to answer the allegations against them. The presiding judge will base his decision depending on the case information gathered.
On the other hand, the plaintiffs or the accusers have a limited time to file their charges under the statutes of limitation. If they were not able to file their lawsuits before the period set by the law, they will not be able to pursue such case in the future – preventing them from obtaining justice or acquiring what they should have got from their cases.
In a civil litigation, a lawyer also plays major role in resolving a case. This goes with the belief that legal challenges need legal experts; especially, in business disputes, wherein several intricate laws may apply. Hiring a competent legal counsel will ensure that all legal rights are properly protected and observed.
